Does CW count in PW in Murder Case.
Court witness is a witness which the court has summoned for clarity/knowledge/receiving of certain documents or facts. The Judge uses the deposition of the CW for the consideration accordingly. The CW is counted as a witness only neither prosecution nor defence can assume him/her to be their witness.

What is the meaning of memorandum of evidence?
A memorandum is evidence in the sense of Section 80. It is a written record of a statement that was made as evidence. A deposition is a statement made before a court to prove or disprove a fact that is in dispute or relevant fact.
Who is a court witness?
A court witness is a person called to testify in a trial or provide evidence. Court witnesses are usually individuals who have knowledge or proof relevant to the facts in a lawsuit. They convey this knowledge either as lay testimony or expert testimony depending on their expertise and experience.
What is the process of evidence in court?
According to the Indian Evidence Act a person who is called as a testifying witness must first be examined by his or her own party. This process is known as examination-inchief. The opposite party then cross-examines the witness and records the statements that are made.
When a witness makes mention of the name of the another witness during his testimony before court, ascertain whether the other witness is named in charge sheet or not and if he is a charge-sheet witness, after writing his name, indicate his rank as charge-sheet witness. (For example CW3). If that charge-sheet witness has already been examined as a prosecution witness then give the rank assigned to him when he was examined before court.
