Difference between dowry and gift

In Hindu Marriage usually gifts such as jewelry and other expensive items are gifted to the girl as a token of love. Such gifts at times may be used to put allegations of dowry against the boy’s family. In order to save the boy’s family from such a situation, the basic difference between dowry and gift is to be understood.

In order to constitute dowry, the following essentials should be there:

1) It should be demanded by one party (groom’s side) against another party (bride’s side) in consideration of marriage, with limitation period.

2) It must entail expectation that the demand be fulfilled mandatorily by the other party (bride’s side).

3) It must be with the intention that the benefits are solely for the purpose of the demanding party (groom’s side).

Gift on the other hand is something which is given wilfully by one party (bride’s side) to the other (groom’s side) without any sort of proposal or demand incurred by the other party.

Streedhan is anything that is given solely to a bride, whether before, after, or during the childbirth, and will be hers. Streedhan, on the other hand, is given voluntarily whereas dowry can be forced or given as a condition of marriage.
