14-Apr-2023 (In Criminal Law)
My wife committed suicide .she was a bipolar disorder patient.I have taken anticipatory bail for ipc306,498a in which i am the only accused.Trial has started in sessions court and the complainant has not been attending the court .Witness warrant is pending since 10 times.Complainant has mentioned many costly things which he has not given. 1)How many times witness warrant be kept pending. 2)Her medical treatment papers are to be submiitted in the court. Please tell me the procedure to submit the documents in court safely as i would be at high risk if i lose them(can i submit personally) 3)The mental illness has been kept hidden in the chargesheet and F.IR.And also many false things (misappropriation of gold)with regards to dowry.Which ipc law is applicable for hiding the true facts(mental illness) and giving false things as dowry. 6)Can my parents still be made accused. They are staying in maharashtra and this incident happened in tamilnadu.

Your case needs a detailed discussion since it is a criminal case. Unless I know all the facts of the case, I will not be able to give a proper advice. The same problem will arise with any other Advocate. Kindly do not take advice on the Internet and follow. It will always be better to meet the Advocate in person and discuss in detail. Your advocate can request the Court to arrest the witness or give up the witness. Also the Police will have to prove all the allegations made in the FIR. You medical records you can file into Court by cross examining the relevant witness like the girl's father or mother. Are you a Maharashtrian? I am from Kolhapur, Maharasthra. Where is the case pending? For any further guidance/advice, kindly contact me.

Opinion could be given after seeing the charge sheet copy. U can confront the complainant when she comes to the witness box regarding the medical records by showing it to her and marking the same on ur side as defenseman exhibit. The court should insist the concert ed police to execute the witness warrant. U cannot help it. If there was evidence against ur parents they would have been made as an accused by now. The medical conditions of ur wife can be confronted only by ur lawyer when she is in witness box.
