sir i am prosecuted under ipc 324 and my case is under trial and the stage of my case is for examination u/s 313crpc as i meant with an ccident and aim hospitalized and undergone surgery which unable me to attend the court in thatcousenbw issued angst me can my lawyer file recall petition in my absence .
Your lawyer can file recall application in our absence , but you should be able to appear before the Judge during recall submission. This means if recall application is filed on a particular day, you can ask for for advancing of the case on a date and you should be present on such date you asked for. Your warrant will be recalled only in your presence. .
