Clear Description of the section 354(A)(1)(iv)IPC

29-Oct-2023 (In Criminal Law)
Last year a person attempted to murder my sister. He had weapons with him. However he couldnt succeed and left my sister with heavy wounds. He is now charged with section 449,452,323,324,326,307,506.His case is in trial,But he is in bail. Two days back,he pointed out his finger at my mother showing her to some of his friends in a public place. We dont know his intention of doing so.So to lodge a FIR what section do we need to impose on him?Is sec 354(A)(1)(iv)IPC valid here? I need ur suggestion as we dont want to go wrong and impose any invalid section on him. Please help out.

Section 354 A (1)(iv) deals with the offence of making sexually coloured remarks. However in the instant case, pointing out finger at your mother , I think is not covered under this legal provision although it is a suspicious act and you may file a report with the police and subsequently file an application for cancellation of his bail under section 439 (5) Code of Crominal Code.

Whenever you make a complaint its always good to make a simple formal complaint and put it infront of the police authorities never ever yourself add sections to it.Therefore it may be covered under various provisions but before that need to be clear that what exactly he said pointing at your mother. It can be covered under relevant provisions of IPC like 506/509/354 etc. Therefore need some more clarity over the same.
