Caught drinking at a public place in Delhi and MLC report is 12

I am 25 years old a resident of Delhi. I was caught drinking at a public place in Delhi. Thay took me to Government hospital for medico legal case (MLC) and reading of alcohol was 12/7070. They took my id and file a case against me and told by the police that I will be informed when to appear in coart. What is my legal remedy as I am not aware as to what charges are being framed against me. I am also going to apply for Immigration for Australia, so will this case cause any issue in my application. Please reply as i am very scared.

Drinking in public place is an offence. You should be aware with this and there is no excuse that you are not aware with that. Bu do not worry there will be a solution for you . you need not to worry. Kindly contacts us and come to meet. We will sort this out.

There is a new law by govt of Delhi that drinking alcohol at parks ; public places and in car n etc is an punishable offence therefore you are charged under that law for drinking in public place . For better help n solutions contact with complete details of the case like a challan or any documents given to you by police

You can get a conviction in this case but still it has to be seen if the case of the police is complete and if there is something in the investigation that we can use to our own advantage. But it is important to move an application so that conviction is not recorded.

You may be fined at the maximum Rs. 5000 as you have committed offence for the first time.

You may Google and read section 40 of the Delhi Excise Act 2010.

Hope you have been only charged with Section 40 (a).

Please meet a lawyer for further consultation with the Challan. He would guide you as regards your submissions before the Court. Though, there would not be an opportunity to you perhaps.
