Case filed against me will it cause any trouble in getting US visa
13-Mar-2023 (In Criminal Law)
Hi Sir, I have bought a scotch bottle (one bottle, 750ml) in Karnataka and was traveling to Tamil Nadu by car. I was not drunk while driving. In Karnataka Tamil Nadu border I have been caught by a Police Officer and he has taken custody of my Driving License. He said I have to appear in court and get back the Driving License after paying fine. Right now I have paid INR 3000 and out in bail. I am working in a software company in Bangalore and my company has applied for US visa. I would like to know if this case will affect the background verification performed by US embassy during visa stamping
BGV will be done with crime bureau database against your Name/DOB. There are various parameters will be checked including your fingerprint, permanent address verification, Driving license number, passport ... etc., . your HR team will be notified, In case Visa is get cancelled. In lieu you may loose you job as well.
Once somebody convicted by any of Indian courts they not suppose to leave the country without prior approval from court.
'B' report can be filed in police station to close this case else, you can go to high court for quash.
** Before I suggest, I would like to know about the case under which sections it is been filed / nature of the crime / jurisdiction .. etc., .
You need best advice from legal expert and you need to act as soon as possible and I have seen couple of cases like this.
