Can the fir be quashed if filled under POC
13-Feb-2023 (In Criminal Law)
a person filled an F.I.R against me under the prevention of corruption act and has video evidence against me.
Now we want to do out oof court settlement.
is the same possible. If so then how can we get the Fir quashed before the charge sheet is filed in the court of law ?
For quashing, the registration of the FIR has to be challenged.
Quashing can be filed before the concerned High Court.
Under what Sections you have been booked.
FIR can be closed by the concerned Magistrate if the same are compoundable.

See as per the Law and dictates of Hon'ble Supreme Court a PC Act case can not be compounded neither it can be quashed by the High Court on the basis of a out of court settlement. For the quashing of an FIR in a PC Act case you need to proof that the preliminary case is not made out. Do consult with the documents including the FIR for a proper advice.
