Can mere verbal communication amount to actus reus
23-Jan-2023 (In Criminal Law)
in a scenario where ms A meets mr B in a book shop and is infatuated by the latter. they started having long telephonic conversations thereafter. mr B after gaining the complete trust of ms A, with the intention to kill msA, persuades her frequently over phone to commit suicide to achieve greater life. ms A attempts but fails. will these telephonic conversations over phone in trying to persuade someone to commit suicide (note here the suicide has failed) qualify as act/actus reus?
You can make a complaint against that person before sho local thana fr compelling you to commit suicide. If no action taken then make a complaint to human rights off at lucknow against police compelling them to take action. You can also file complaint case at district court.
Yes telephonic conversation or any other conversation which compel to anyone to do a crime or provoke to attempt to commit a crime is also a offence and in suicide case either someone fail but it's a offence
You can stretch the case as attempt to abatement to suicide, nothing more than that...although that is still far fetched, what has been narrated doesn't constitute an offence as such, because the mental capability of ththe person who tried to end her life is also relevant and the fact that she got lured into it does not help your case a lot.
Yes it does. Please refer to Section 309 of the Indian Penal Code. This falls within the purview of abetment. Whilst act of suicide has not been committed, the action of aiding the individual to attempt the same is a crime as per the laws of the land.
Hello,
Regarding abetment, the offence is completed irrespective of the successful culmination of the offence abetted. It is irrespective weather the person who was trying to commit suicide is successful or not. This is also clear from the definition of abettor as provided in IPC which reads as follow:
“108. Abettor.–A person abets an offence, who abets either the commission of an offence, or the commission of an act which would be an offence, if committed by a person capable by law of committing an offence with the same intention or knowledge as that of the abettor
