Can magazine be sued if they dont deliver magazine after suscription

I subscribed for a magazine for one year starting from Jan 2017 but the magazine company has not dispatched the magazine so far and when asked over phone they dodge and they do not refund the amount also.Can I sue them under Sec 420 of IPC?
You can file consumer case before district consumer forum under section 12 of consumer protection act for deficiency in service of said magazine along with direction praying for proper service at regular time along with compensation for mental agony and you are a consumer and you within purview of consumer act. But normally section 420 of IPC not applicable since it is a consumer dispute.further you can file civil suit for return of subscription amount from magazine. But both civil suit and consumer case are not maintained simultaneously together. You apt for any one.

If the magazine doesn't give you the copy you can send a lawyer notice along with the receipt copy .you wait for a week.usually they will start serving the magazine .then you can give a police complaint.
