Can I get bail on the ground that I am a widow with 2 kids u/s 420

In my last post I didn't mentioned the charges upon my sister. She charged sections 467, 468, 471, 420 & 120B. As per my assumption she may be accused of section 420, but rest are charged under pressure during her PC of ten days. Police put 3 more names in the case with her who are still out of trace. As I mentioned earlier that since 28feb she is in JC till 14march. And her status of a widow with two kids whose education & living is drastically affecting. She was in a private job which also no more. So please advise whether she can get bail in this situation and if so then on what grants.

Forgery sections are firstly non bailable sections secondly punishment is higest 10 years and minimum 3 years . Truly suggesing your sister will not grant bail in the magistrate court plz appeal before district cout that is session court u/s 439 You may grant bail on the ground of woman being widow and not a chance of absconding as two children are dependent on her. And you can appeal before district court again if bail is rejected. Otherwise High court is there . Dont waste the time if you want bail appeal u/s 439 of cr.p.c IT IS DIFFICULT BUT NOT IMPOSSIBLE. It has to be tried before the learned court that your sister is a widow and has children who needs mothers care upon certain conditions from the respective court and if the judge is convinced surely some positive results may turn up.

Yes that ground is supporting the bail matter and chances the bail on 14 Mach cause pc results is fulfilled and she is a female accused and she is widow and having two minor children. She is in judicial custody 14. Days.

MY OPINION THAT you have mentioned that your sister is widow , she has two kids,she is now in JC still continued upot 14 th March, i think if there is any specific reason /reasons are involved there or not,you should move at higher forum for get bail.

It is the First 14 days period. As the offence is Non-bailable one I think it will be better for your sister after seeing 14th day of March you can apply for 439 before Ld. District Judge or before the Hon'ble High Court.
