Can i be charged for theft only on ground that i was present at moment

Can i charged or convicted for phone theft/ pickpocketing if person blames you saying i was the only person standing next to him at the time and i could be the only one who has done it. Is this enough proof to charge / convict someone or will he need to prove.

You can be charged for an offence of theft but it is the prosecution that has to prove its case beyond any doubt that you had committed the offence, unless there is any proof to that effect you cannot be convicted for the said offence. Prima facie i believe you have a good case

Yea..Obviously any charge has to be proved or substantiated. You could be arrayed by the complainant but you have to be present at the time of enquiry. And you always hold a chance to plead your innocence. Is there any FIR registered?

It is not so easy to prove, he has to substantiate lot of things, before getting into this, he can make allegation, but it is for prosecution to prove. So wait for your turn to prove innocence, and wait for things to unfold.
