Can brother's widow ask mother-in-law's self acquired property ?

i Facing Assault case over me by way of black mailing for property by my younger brothers Widower who now want to recover my fathers by will transfer to me a house and my mothers property which is self earn by her and there is no ancestral Property in my family.She already got Property from my Brothers Separated Property already we given.then what about falls charges she alleged on his plea. Under Section 354. and dv act for harassment. Please Help to Provide What Courts View Regarding SUch Type of Cases they Run and Judgements in Recent Cases by HC and Apex Court in Such Matters.

Answer with regard to first part of your query is in negative. Daughter-in-law has no right to claim share in self acquired property of mother-in-law. In second part of your query, you have not provided complete facts of your case. As far as charges u/S. 354 of IPC and DV Act, are concerned, these are grave charges. Court is not expected to take lenient view. You have not mentioned whether your brother's widow is living in your joint family or separately. In respect of charges under DV Act if she is living separately you would not face much problem. In respect of charges under S. 354 IPC which is very grievous charge, is about outraging modesty of woman and not about simple assault, you have to prove that nothing like that happened. You have to deny that any such incident of assault has at all happened. Had you provided details of allegation, it would have helped you.
