Can a constable send summons through WhatsApp

07-Dec-2023 (In Criminal Law)
Dear sir, Today I received a call from a constable of wps, stating that i need to attend court for hearing for a 498a case filed by my wife. When i said i haven't received any summons from court, she told she would send me through WhatsApp and she sent me. At the bottom of the page it was written " Advocates co op society Ltd, Hyderabad ". Is this the right way of receiving summons? If not what step should i need to take?

It depends on the discretion of the Judge though your Advocate can contend that the summons was not properly served to you. In a recent case, a Delhi court termed as “deemed proper” the service of summons via SMS, and e-mail. Good luck.

Hi
Advocates coop society normally is approached for payment of security deposit for grant of bail.
Summon's through whatsapp is not recognized in law.
So better check the court records through your lawyer and make an appearance through your lawyer.
