Baseless Rape Allegation by a former employee

Hi.My jiju had a lady employee at her shop.When he was unable to afford her salary he told her to leave n look for job somewhere else.But she said that she won't leave n started emotional blackmail.Then she told my jiju that he loves her n that she want to have live-in relationship with him. When jiju tried to ignore her,she attempted suicide.She also told women-cell personal that she just want to have live in relation with jiju. She was also sent to mental hospital. But after getting released from there she had filed a case of rape.Police say that they can't help jiju because now a days all the laws favour women... What should we do?
Hi, this is a very sensitive case. Now you have to step very cleverly. Try to gather proofs against that girl. You here have not clarified weather FIR has been lodged or not. If FIR has been lodged, go for anticipatory bail. Also, you may apply go Anticipatory bail before FIR too if you apprehend of arrest. Whether you had made any complaint in this respect in police station of harassing , mental torture and blackmail. These fact can be established in so may way if your Jiju did not live in relation. These facts can be ascertain the residence where they live together and other so many things. In the meantime you can also file anticipatory bail as a legal recourse.

Your Jiju is advised to lodge a report with the police beforehand and get the acknowledgement of the same from the police. He should also report the matter to the senior officers as well as to the women comission.Your sister may also lodge a report to this effect to the police as well as to the women commission as a precautionary measure. These steps would dilute the matter and would help your Jiju in his defence in case the lady lodges a false complaint of rape against him.

The allegation of rape is very serious allegation and is a non bailable offence in which police will immediately arrest the accused. If the medical report of the victim shows any sign of sexual intercourse then the Accused have to go to jail.
The only chance is if the medical report denies any sexual sign.
