After payment material not delivered in 10 months

Last December we gave order to supply material worthRs 1lakh, advance of 10000 paid immediately.After3-4 days supplier said material ready and send usproforma invoice on that basis we have paid the full amount. The supplier even send USA builty number. But the material never arrived. On enquary it was found the built was fake. There after he started playing by sending material in installment 1.fist time (after 2 month)material worth-28000 2.second time(after 6 month) material worth-20000 3.third time (after 10 month)material worth 2000 We would like to file a case of cheating under ipc420. Please advice the proper procedure

(a) You may file a criminal complaint of cheating with the local police;

(b) You may also file a complaint with the local consumer forum for recovery of your money.

(c) If it is company incorporated under Companies Act, you may seek its winding up for failure to discharge 'admitted

liability'.

however, you remedies will depend upon the documents available with you. It may be better to engage a lawyer.
