After legal notice non refunding of money

I had sent a legal notice gainst refunding towards a person who tried to cheat me in business he has refunded half the amount n hasnt refunded anything after that when i went to his place he went on gving me dates n has never kept his word
What was the mode of payment? If it was through cheque and is within time limit prescribed under the statute you can file a Complaint u/s 138 of NI Act. Else you have the option to file a summary suit against him. Consult me for further help.
