01-Feb-2023 (In Criminal Law)
One person has stole some cheques out of which he cleared 2 cheques through bank account of my client ( at the time of clearing the cheques my client was unaware of the fact that the said cheques were stolen cheques and my client was also paid rs 5000 as commission in lieu of clearing these cheques into his bank account) whether my client will be guilty under section 120b of ipc.

This is not a criminal conspiracy but that said act is related to criminal misappropriation of property well it is a lesser degree but in this relation I can advise you to return the amount to that person from whose account you have withdrawn 5000 rupees... again you can recover that amount from the original respondent...

Yes if your client has paid 5000 as a commission then he would be treated as a part and parcel of criminal conspiracy. But before giving a comment over the same it would be more beneficial to know the facts of the case please contact for further details thanks.

Hello,
Immediately take an action against those cheques, also instruct bank for stop payment, make a general diary to the nearest police station along with cheque details.
Your client can also make general diary to nearest police station, if he is guilty then take an legal action against him.
