Supreme Court's order on company winding up

29-Oct-2023 (In Corporate Law)
The High Court Calcutta on February, 2013 passed a judgment to wind - up Dunlop India Ltd. for settling creditors bona-fide dues which are outstanding. Then the Company filed an SLP (civil) 18265-18266 of 2013 in the Apex Court that passed a stay order on the wind up judgement. My father was also an intervening applicant. On July 29, 2016 the Apex Court disposed the SLP as the Company failed to comply with the Apex Courts order to deposit Rs. 25 crore with the Official Liquidator Kolkata. My father a retired management staff of the company has substantial dues remaining unsettled by the company. Over telephone the Official Liquidator, High Court, Calcutta communicated to me that they are yet unaware of the disposed status of the SLP and required a formal order from the Company Court directing them to initiate liquidation proceedings. What should we do now as the Supreme Court's stay order on winding up is no longer extant.

Dear Sir,
Perused your query in detail. Now please note that the High Court atCalcutta has passed the winding up order of Dunlop. The stay order of Supreme Court is no longer there. So what you need to do is file an application before the Company Law Board and seek a direction for proceeding with the liquidation. Please contact for more details.

Dear Querist,

Write a letter to the Official Liquidator, enumerating all the details along with the copy of Judgment and request them to execute the liquidation proceedings and enable disbursal of your dues at the earliest.

Thereafter, wait for one month and incase if you dont receive any reply the make a formal application in the company court for prompt liquidation of the assets of dunlop.

Regards,
Sohail Haque.
