Well the DPCC I am guessing must have sealed the factory for violations under the Air and Water act. It is important to see whether the due process of law has been followed by DPCC. The factory can always file and appeal before the appellate authority. In case of offences committed by a company, every person who, at the time the offence was committed, was directly in charge of, and was responsible to, the company for the conduct of the business of the company, as well as the company, shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly. The punishment/ fine depends upon the nature of the illegality. The licenses and permissions possessed by the factory are also relevant. The factory can be desealed approaching the court for necessary orders for desealing.

If the factory premises is illegal itself then the concerned authority has the right o seal it for it being operated illegally. The factory is commissioned as per the factories act, 1948. there are different pre requisites for running a factory. Now it has to be seen under which provision of law your factory has been sealed. Yes there is penalty and punishment.
