Need file suit on harassment against ex employer

12-Jun-2023 (In Corporate Law)
Hi, I have sent the legal notice to my previous employer regarding mental harassment as they didn't give me my FnF and relieving letter for new job. This led to lot of suffering to me and my family. Now I want to file a suit against the company and seek the compensation anywhere between 15 to 30 lacs.

You have following options (a) Civil Recovery Suit under Order XXXVII (37): Summary or Money Suit can be filed for recovery of dues before civil court; (b) Out of Court Settlement: You can appoint mediators or arbitrators to settle the dispute between Employer and Employee if the employer is partially disputing the dues and is ready to settle the matter amicably; (c) Criminal Remedies under IPC: File a criminal compliant for Criminal breach of Trust, cheating or mischief; (d) Winding up petition under Companies Act 2013 before NCLT after issuing the Statutory Legal Notice on the registered address of the Employer subject to your confirmed legal dues; (e) Recovery of FnF dues has various components as per structure of salary and dues and there are procedures and time lines for payment of these dues are prescribed by the relevant statutes like the P.F Act or Gratuity Act or the Industrial Disputes Act or the Shops Act or the Factories Act etc hence If you are workman or employee under all statutes then you can approach respective authority or file a complaint before labour court for appropriate relief. Choice of remedy shall have its own recourse timelines and relief. Fastest remedy depends upon the facts and circumstances of each matter.
