Manager of company filed false affidavit how to proceed legally
11-Aug-2023 (In Corporate Law)
The manager of my company filed a false affidavit in the capacity of legal representative of the company to ROC Delhi, RD, Chief Secretary. How can i proceed now ?
You can flag the issue to police if that act of his own is detrimental to the benefit of the company or is helping the company to gain undue advantage.
If you are a shareholder of that company then you can send them a notice and can seek an explanation thereto and then can move to ROC and subsequently to the NCLT for the same.
If you are just an employee then approach the police with a complaint of your own and then get it converted into a FIR.

In a capacity as Director you can write letter to Roc stating that your company manager filed false affidavit without consent of majority directors or members hence please take required action. But the burden of proof will be on you who will challenge that affidavit.
