Ill Treatment after leaving Genpact

Hi Sir/madam My Name Is Amit Kumar Pandey and i was working with Genpact for almost 4 Years .However ever due to more leaves Genpact had terminated my services and then they gave me relieving letter instead of termination .This letter was provided me to avoid termination procedure as they had to pay three months advance salary. Now when i joined a new company then they gave a negative feed to my current employer that due to performance issue they had to ask me to leave which was complatelty incorrect.As i was top performer in Genpact and feedback was being closed on monthly basis as very good performer.Instead of mentioning the reason for leaving was leaves they are giving worng feedback about my performance .Now i have sent several mails and also contacted to Exit team to rectify and correct the error but nither HR nor exit team is helping me .Now please suggest me how do i proceed leagaly ,because this will be a negetive mark on my carrer .

You may file a suit to seek damages for defamation and seek injunction relief against Genpact to prevent Genpact from making public and/or sharing with a third party libellous content about you which has the consequence of damaging your reputation.

As your previous record was the good but even then they made your negative report for that purpose I suggest you to file a complaint case in labour Court again I would like to tell you when you will make a complaint before labour Court mention all details in your complaint

Send them a legal notice in which you have to describe that if you are not rectify the said error so that soon I am initiates legal proceedings against you in civil or criminal nature.

Give them time of period of 15 days.

As I mentioned in my previous response to your query... a lot depends on your contractual terms with Genpact. Whether you file a case against them seeking injunctive relief regarding the misleading negative feedback they are giving to your new employer will depend on any legal right that you may have in that regard. So please consult a lawyer with all necessary papers to evaluate your legal options in this regard.

Dear Amit, Do you have any proof to substantiate that you were a good performer at Genpact?What were the actual reasons for your leaves; had you ever e-mailed your reporting partner/boss that you will extend your leaves and these are the reasons for the same. Do you have good relations with your immediate senior? Did you exchange any correspondence with your ex-employee at the time they issued a relieving letter in your name? I would like to see the contents of the letter. There are lot of facts that I would like to gather from you before I can advise you further.
