If other party fail to pay agreed amount what legal action can I take

HI am going to enter an agreement with an it company to render some services after seeking my services if they fail to pay the agreed amount stated in MOU with in the due date what eligibility i must acquire during entering in to an agreement is only MOU Eligible to file a suit Against the company incorporated as per companies act 1956 payment schedule included in MOU
