Balance sheet not signed by director can I file a case against auditor

We are two Director of private limited company. We have disputed among us .We both have 50 % of share holding of the company. One Director will capture all cheque book and all account control under him. He started new company & diverted all business in new company. business of the new concern is of a similar nature as that disputed company. For the FY 2014-2015 balance sheet is not signed by me & not approved by me although he files the company income tax return. With his signature. Auditor also signed the audit report. Can I file a case against auditor also?

Prime facie a case can be filed against the directors.

No you cant file case against auditor.
You can file case against director who have started new company and diverted tall the business in new company.
