Regarding copyright laws

Dear Sir, I am an aspiring filmmaker from India wanting to make a short film based on a literary material published by an American Author in 1957. The writer died in the year 2002. I would like to know if the aforesaid material falls into the category of copyright free literature or not. And do I need to get rights.

Copyright Law regards protection in and to literary works for a period ranging from approx 55 - 60 years plus the authors life.

The writer having died in the year 2002,It has been only 14 years since then. Thus, it does not fall into free literature category. You shall need a license to use the copyright from the legal heir to the copyrights of the deceased author.
