is linking to infringe content illegal in India and abroad

I made a website in which i post links. Which are copied from other websites. When someone click on my website link, he will jump to other website to download files. I want to know that "linking to infringe content is illegal in India & Abroad" ? If No, then I can continue to work on my website ? If yes then what should I do ? Please tell me solution asap. Thanks

Dear Concerned,

Any propagation of any infringing material, whether directly or indirectly, amounts to infringement. Therefore, the answer to your first query is yes. in so far as the second query is concerned, you are advised to inform the exact nature of the material and your portal.

Linking has to be checked on case to case basis to ensure that no IP infringement is taking place in that particular case. However linking activities may expose you to liability for contributory copyright infringement if you end up link to works that clearly infringe somebody's copyright, like literary work, pirated music files, video clips of commercially distributed movies etc.Bottom line it’s a risky business to link without checking.
