Can we use pictures from from government website for reviews

15-May-2023 (In Trademark & Copyright Law)
I would like to ask if we can use car pictures directly on our website from the company's official website - for writing reviews about them and giving option for customer to buy it from our associated dealerships. Do we need to take any special permission from company or can we directly use those pictures as that would be kind of free marketing for them. Please let us know, who would be best person to contact in case we need to take permission from company. Thank you.

Dear Sir,

Thank you for the query.

Please take permission from the company before using the pictures. Without permission you cannot use the pictures. Please contact legal department or company secretary, or any other person having higher rank in the company.

Kind regards,

Shashi

No you can not use pictures of cars directly from the company website as the photographs may be subject matter of copyright. Copyright in a photograph will generally reside with the photographer unless the photograph is commissioned by a person in which case the copyright will reside with the person who has commissioned the project. Your best bet may be to approach a photographer to commission them to take photographs of cars for you, in which case the copyright in the photos will vest with you. In case you want to contact the company, your best bet would be to get in touch with their Public Relations Departments.

Consult marketing executive in company main office for NOC/consent. It should not be a problem since this wud be beneficial for the company but one never knows. Alternatively, use different pictures one which you can take yourself from Cars available on road or showrooms.
