Dear Sir / Madam,
As per, Central Government Act Section 11 in The Trade Marks Act, 1999 every trademark have to be registered. The registration is required for various transactions with private / government institutions. If the canadian company already registered it's logo and name in India then it would be illegal for you to use and you would get an objection at the time of registration. you may need to file response to the objection with in a month else your registration request will be quashed.
If you still use the logo then not only the canadian company has right to sue you.
