what should i do if opposite party advocate is not present ?

I filed case against education institute in consumer court in 2015. The final argument is to be made in this case, but the lawyer of the opposite party is not present for final argument from six months and every month he is giving excuses and taking the next date. Can you please guide me what should i do if opposite party advocate is not present for final argument this month ? And can i request to consumer court to transfer this case to lok adalat for early decision ?

CPC restrict no of adjournment to three in virtue of which if the adjournment has exhausted this limit, you may ask for an exparte decision. In addition, SC direction is there to handle such cases expediently.

if opposite party is present in case regularly... you can request to respected consumer form to give direction to opposite party for filling written argument if his lawyer is not able to present in court..

Please file application under section 151 CPC for final disposal of the case along with complete order sheet of the case showing that the opposite counsel is seeking repeated adjournments when the matter is pending for final disposal.
