15-Mar-2023 (In Consumer Court Law)
I failed to pay my Idea mobile bill of 3000 post which my mobile connection got suspended. I just want to know what legal action can be taken if I do not pay the bill. I have been getting rude and harassing calls from Idea's recovery agents for the due bill.
Hello,
For the query you posted, I would advice the following;
At max you could get a notice for payment of such Bill, else not a lot can happen. You don't need to worry much for the same. No court routines would follow

How long can you go without paying a phone bill?
Utility providers may terminate services as soon as a week after the due date of the bill and charge a large amount to restore them. Some companies, such as phone providers, can shut down service between 45 and 60 days after the due date. 11-May-2022
What happens if you don't pay free mobile bill?
You could be cut off by your mobile provider, so that you cant make or receive any calls. Your account will default if you do not take action to settle the debt. The contract will also be cancelled if you fail to act. After the usual debt collection procedure, the mobile provider will take steps to recover any outstanding bills.
Is non payment of bill a criminal Offence?
Indian Penal Code Section 406 covers criminal breach of trust. Seller can bring suit for trust violation. The seller must prove that the customer betrayed his confidence by refusing to pay for goods or services.
What will happen if I don't pay my postpaid bill?

well it is a long time consuming process, do not expect any penal process, they will keep calling you for mediation for the next 2 years and keep calling you for the lifetime. You can even settle in lesser amount.
You can take legal action against those persons or idea's recovery agents who calls you by complaint against him in police station or call 100 no. They have no right to harrashed you by way of calling or any other wat
It's better to pay pending bills. You must be receiving fake calls and notice from mobile company to pay your pending bills. This is a standard practice adopted by mobile company. However, practically it will stop after some time. In India it's difficult to recover pending bills from customers. I would suggest to pay your bills.
Technically/legally advising there can be consequences where a civil suit for recovery can be initiated against you where the amount along with other costs incurred in recovering(legal) such costs would be recovered from you through regular court procedure
But generally advising at max there will be a notice or two and a few hundred calls from persons posing as lawyers(basically agents who work for company to recover money) will call you and at worst you might get a legal notice .That will be all, as a sum of 3000 is too less to continue with the entire legal costs and those on panel are generally not paid as much to undertake entire procedure. Companies are for profit making in real time any futuristic plan of action is not in their modus so as to wait for as long as one or two years to complete the legal process and take the money from you. Even if the process is initiated you will always get an opportunity to clear a bartered debt, even at a legal forum be it a court or a tribunal

Many telecom companies disconnect your connection before filing a suit. If the bill is not paid, the companys agents will call you back to back in order to remind of payment. In the event that both of these methods fail to recover the amount owed, companies will turn to debt collection agencies.
