What is the Jurisdiction to file case in NCDRC against builder

I filed a case against the builder in NCDRC for the delay in possession . Now builder has come up with response that im not a consumer but a investor and i bought it for a resale purpose . But the fact is that i bought it for my own stay. I have another property in same city which has been rented out and i don't consider that property fit for my own stay as that is very small , not in a gated society and is without modern amenities . So how i prove to the court that i bought it for my own stay
Did you plead specifially in your complaint that you had made the booking for self use? Did you buy in name of a person or a firm / company? Without seeing the petition (complaint) and reply none can advise you properly.
