Web Development co. in India not working as per contract

Hi, I gave a web development contract to one co. based in India, coimbatore. They agree to complete the task in 35 working days but its been more then 135 days & they are to complete task. now not responding to mails / calls.. what options do we have legally

For the query you posted,I would suggest the following:

You can always start by sending a legal notice to the said company and thereon if the contract is not performed within the stipulated period mentioned in the notice, you can file a suit before the concerned court for non performance of the contract as well as damages.

You can take actions as per clauses of contract or file a suit for specific performance if there are no clause regarding arbitration.you can also send notice prior to filing of case regarding the performance of contract or any there releif

Hi,

In your case you can go to the Consumer Court, but first you need to provide some more details about the same which as follows :

1. Value of Suit means how much loss you incurred
2. Your location where cause of action occured,
3.What services he has to provide you, and he didn't provided

After acquainted all these points, it will be decided where the suit have to institute.

You have all legal options open against them. 1. Cheating and fraud criminal case. 2. Recovery suit for your money if you have paid anything in regard including compensation and damages if any due to their delay. Usually in these type of cases company plea with point that party altered with their initial project from time to time due to which the delay was absolute and not their part as liability for it. But if anything has not been made from you in writing for alterations in regard their plea will dissolve and case will be yours. Best of luck.

There is a contract which is signed by the parties before getting into any such settlement as is there in the present scenario. The best way tk go about it is to send a legal notice and take necessary steps.
