Terms of the contract not fulfilled by builder what action can I take

Im representing a groups of Allotees form Group Housing Society, wherein the underground high tension wire has gone faulty just within 6 months and also the builder has not marked / allocated parking space to each of the flat owner, whereas it is very clearly mentioned in the offer document that they would allocate independent covered parking to each allottee. can we takeup this matter for refund /relief on account of Parking space and can we have the faulty wire replaced by the builder at his own cost. Kindly advise, we are more than 912 effected allottees.

Hello sir,
First if all we will discuss about the High tension matter, sir in this we can approach directly to National commission delhi and stating all things according to your buyer agreement. Secondly with regard to parking space you can approach directly and seek comprnsation for harassment and mental agony and also in a recent as the RERA came into force the court is of the preview and will give decision to give appropriate parking space to the residents else refund the entire parking amount with 12% interest and 2 lakh rupees compensation for harassment and mental agony and 50000 for litigation expenses. There are many supreme and High court judgements.

Please send a legal notice or representation and then file a case in consumer court of requisite jurisdiction. As there are 912 effected allottees , case can be filed in the name of society vs. builder.
If possible, try to make a representation to the builder and take possible time frame for fulfilling this requirement in writing. This attempt of yours can save you a lot of time in consumer courts later. And then hire a professional competent lawyer for the service.
