Software development vendor delaying delivery of product what can I do

Hello, I am a startup entrepreneur who left my job to pursue a dream. I came across a software development company in Bangalore through a website and offered them the contract to build a product for me. The agreed time frame was 2 months. Even after 4 months having passed, the company is acting arrogant after having taken 60% of the agreed fee and nowhere close to even 30% of the work completed. They find new ways to seek time and remain incommunicado despite my repeated attempts to reach them. I want them to return my money. Please advice.

Breach of contract , you have to go by terms of reference. If the terms refers for civil and criminal proceedings the same can be adopted to recover money, and if terms insist on Arbitration, in case of disputes between the parties, the same has to be followed. In the absence of above said things you can initiate civil proceedings to get your Money back, criminal proceedings is not advisable as it is only breach of contract and not breach of trust. This advice is based upon your inputs without going into merits of the case.

You first issue a legal notice intimating their unpleasant and non-cooperative attitude/behavior especially after receiving 60% of the amount as per the terms of contract and can inform that you are terminating or cancelling the contract between you both due to breach of contract committed by them by not fulfilling the contract conditions or completing the task within the time stipulated and you demand the refund of the amount so far given to them with interest from the date of payment till the date of settlement.
If the company is failing to comply or respond then you may may drag them to consumer forum for recovery as well as for compensation due to deficiency of service as well as for the mental stress/agony caused by them to you.
