Refund of Holiday Plan purchased from Journeys from Jukaso

Hi,
I had purchased a 10-year holiday plan from Journeys wherein I would get a a fixed number of day vacation at the various properties owned by Jukaso Hotels for 10 years. I had applied for cancellation of the same and a refund of my money withing the stipulated 15 day look in period as mentioned in the contract agreement sent to me by Jukaso. But they are not refunding my money. My query is:
1. Can I file a case against Jukaso in Consumer Court.
2. If I file a cases what is the usual time within which a judgment is given.
3. What is the estimate of expenses.

yes you can definately file a case against Jukaso in consumer court. At present the consumer courts are experiencing heavry back logs if cases as such you may not get more than 3-4 dates in a year . As far as expensws are concern you need to seek advise from a lawyee who can assist you through out the process.

You can definitely file a case in the Consumer Court. The case should take anything between 3 to 6 months depending on where it is filed and how that particular Court operates. The expenses entail a court fee depending on how much amount is sought for refund. it varies from Rs. 100 to Rs. 4000. Apart from that if you intend on hiring the services of a lawyer then his/her fee will have to be paid.

If you are asking for a cancellation within the time frame stipulated in the agreement then they have to return your money and if they delay they will have to pay with interest and also the cost of litigation and inconvenience caused to you. You can file a case in the consumer court. Other details may kindly be discussed personally.
