purchased product online not in working condition refuse to pay

I just bought a microphone from XX but when I opened the packaging the main microphone packing was full with dust. the microphone was not working and it's switch was also jammed. Now after the complaint XX is saying to repair it as it is in warranty. warranty of product starts when I used that but I received and open the product was already defective. Now they refuse to change that, they says you are not legiable for that.
You can approach the consumer Court as per the jurisdiction and can also hire a lawyer of you want . Keep with you the bill and order sheet. They Will have to change it as it is u der warranty and the mistake is bding done kn behalf of the company. You can also Contact me for further consultation
