Purchase of pre launch offer flat but did not receive possession still

I have booked a flat on pre-launch offer.It is already 3 years and the flat is not ready nor the construction started.They have stopped the rentals after giving 3 months rentals.I have lost hopes of getting the flat as they are very rude in answering my queries.Should I submit the cancellation letter and then go to the cosumer court.Within How many days will I get the court decision and how much I have to spend for the lawyer.Expecting your kind help.

If your builder did not deliver as per promise or misrepresented you facts. And if they are practicing unfair trade practice, you may immediately cancel your booking and ask for refund of full amount along with interest.

first send them the notice through advocate Seeking with all your grievance. Fail to give proper rely, you can proceed further to file consumer complaint claiming compensation for not handovering the possession in time .

Dear Sir/Madam, you have to issued a legal notice to the said builder and to file petition before the district consumer forum for claiming a compensation for delay and mental agony. It will depend upon court, lawyer and client, it will take minimum 6 months. You have to pay lawyer fees it will vary from lawyer to lawyer and miscelleneous expenses as on actual basis.
