Product delivey cancelled from e-commerce website
20-Dec-2023 (In Consumer Court Law)
Hi I have placed an order in e-commerce portal. There was a huge price gap for that product and I found it and purchased that product. Later that order has been cancelled by e-commerce site with out contacting me and refunded money. I am asking them why did u cancelled. They said product is unavailable with the seller and hence we have cancelled it. Actually product is available with the seller and he has called me for order cancellation due to huge price gap and its mistake in the portal. I have denied to cancel the order. In this case can I file a complaint on e-commerce website. I am not sure about their hidden terms and conditions
Yes you can. Displaying the product with discount is an offer made by the seller, you accepting that and paying for it makes it a contract. So now if there is any breach of contract you can seek damages under the consumer protection act or contract act.
As per my past experience, the online companies generally give a discount voucher equal to the discount when the order is cancelled by the seller as there is no fault of the customer.
