Penalty not paid by builder for delayed construction what can I do

Hi, I have booked an under construction flat in Bangalore in 2013. Builder agreed to construct the flat in 1 year but he delayed the construction by more than 2 years. It was mentioned in construction agreement that he would pay the rent for delayed period but now at the time of possession they are not deducting any rent. What legal action I may take against them? Also would it be advisable to take this issue to Consumer court then district court?

Hi
It is not fair if your builder is not paying the rents although it is agreed upon. Hopefully you have an agreement in place, in such scenario pl.file a consumer case for deficiency of services, mental agony and compensation. You will get redressal for your grievance, nothing prevents you to go to civil court for damages.
