Paid more then half of the amount builder is not giving the agreement

I have booked a property at Ahmedabad for Rs. 31 lacs and till now have paid Rs. 25.31 lacs. My builder is not ready to execute Agreement duly registered with SRO and says first I have to pay in full and then only it will be executed. Is this a correct step from the builder ? My builder says since it is a free hold land he will give it only after payment received by him in full from me. Whether he can refuse to give Agreement ? I want to know the legal status on this aspect and want to know the correct situation.

No this is not correct. The Agreement has to be executed and registered by the builder even if you have paid 33% of the total amount. Ask the builder to execute a registered agreement and pay balance amount at the time of registration. If he refuses you may issue legal notice thru advocate and file complaint with consumer forum.
