Opposite party-builder is not appearing in the court

I have put consumer case against the builder to refund the complete money. After agreement he told that he is not going to provide OC. Also completion date he has mentioned in the agreement is Feb-2015. Till date he has not completed the construction. But even after putting the case he is not appearing to the court.Already 5 times court has sent the notice to him. But he is deliberately not receiving the notice. So please tell me the ways to make him to appear in the court.
You can lodge a complaint for criminal breach of trust and action will be immediate on the builder. The 2nd option is to do a due diligence and find out the correct office address as sometimes they change their office address. Should you need any legal assistance please feel free to contact.

Dear Sir/Madam, you have to take further steps through substitute service by way of paper publication in local daily news paper for appearance of the court, if not appear the Hon'ble Court may be pleased to pass an exparte order against the said builder/opposite party and get the order and to file execution petition against him to execute the said order which you want in the court order. You may contact your lawyer and take his suggestion as what he wants to do ,taking suggestion from other lawyer might not be of any use as your lawyer must have some strategy to proceed, better be in contact with your lawyer and short out the issues....that would be better...
