You can contact the agency you purchased the machine for, whichever it may be (retailer or the company) and ask them to refund the money. In case they fail to do so, you can file a consumer complaint before the concerned District Forum .

If the machine is under warranty then the replacement has to be done by the company or the vendor you have purchased it from depending on the warranty conditions and the contract between the manufacturer and the vender. If they do not honor the warranty conditions you can approach the consumer courts for the refund and plus compensation for your loss.

If it's in warranty you may contact your manufacturer. If he has denied, then you may proceed to send him a legal notice. And further if he still is not responding positively you may file a consumer complaint

If it is under warranty and it is stated clearly by service center that it cannot be rectified or service engineer has paid many visits at your home but still it is not rectified then in that case you can get full refund of the paid amount plus special damages or compensation from the consumer forum.

You can ask your dealer to replace it and if he refuse to do, then send one written complaint to the sales department of the company and keep one copy with you. If still you don't get any reply from them, then send them legal notice and after that file one Consumer Complaint before District Forum, under Section 12 of Consumer Protection Act, 1986.
