liable to pay maintenance charges for society

23-Mar-2023 (In Consumer Court Law)

I had purchased a resale flat in May 2014. The society was not formed at that time and hence I have taken NOC from the builder on standard format of HDFC Ltd , from where I took a home loan.By getting NOC, I thought that all dues of the owner will be cleared before issuing the same. Society was registered on April 2015 , Members were elected in August 2015, and now they are asking me to pay the maintenance charges for the period April 2013 to May 2014. Am I liable to pay dues of previous owner ? Can the society charge me maintenance for the period before it was registered?

You are not liable to pay the maintenance charges for a period during which you were not the owner of such premises. You shall not worry and no legal action can be taken against you.
