I HAVE GIVEN RS 7 LAKHS AND 10 THOUSAND AS ADVANCE TO ONE PROMOTER FOR CONSTRUCT THE HOUSE NEAR TRICHY TAMILNADU. NEARLY 7 MONTHS COMPLETED AFTER REGISTER MY LAND NO ACTION TAKEN FROM PROMOTER STILL DATE .TOTAL COST AS PER DOCUMENT ONLY 3 LAKHS AND 3 THOUSAND ONLY .NOW I HAVE ASKED PROMOTER TO RETURN MY EXCESS AMOUNT OF NEARLY 4 LAKHS AND 7 THOUSAND INCLUDING ADVANCE 10 THOUSAND. BUT HE REFUSED TO GIVE AMOUNT ALSO HE IS TELLING 50000 ONLY AVAILABLE . HE IS TELLING LAND COST OF 6.5 LAKHS. BUT I HAVE NOT ACCEPTED THE SPECULATION. NOW WHAT TO DO FOR GETTING MONEY FROM CHEATING PROMOTER. I WILL RAISE FOLLOWING QUESTIONS AR RAISING IN MY MIND . 1. POLICE COMPLAINT TO TAKE ACTION AGAINST PROMOTER OR FILE CASE IN DISTRICT CONSUMER COURT FORUM TRICHY. PLEASE GUIDE ME FOR SPEEDY MONEY RECOVERY FROM DEFAULT PROMOTER?
First you send a legal notice along with necessary documents regarding this issue ,to the promoter company. Then wait for one month. If that promoter company does not comply with the issues then give a complaint for cheating and also can file a suit against him for recovery of the money. Act in accordance with law.

You can do both simultaneously. For cheating you by promising something and taking money on that promise, for which you can file a criminal complaint with the police. Also, approach the Consumer Forum for the deficiency in service where you can claim damages and refund of your money.
