Legal Options for delay in getting the property possession

I have bought a property with Prakruthi Solitaire phase 2 , Nandhini builders and the possession date was mentioned as October 2014 , but still in April 2016 the property is only 80% completed. The builder is avoiding to meet the customers also and not answering the phone calls. What are the legal options we have to tackle the builder in this case and get the property completed soon or get proper compensation. There is a Rs 5000 per month compensation clause as well in the agreement for the delay. Builder is not giving that also and is saying that it will be adjusted in the final settlement.

As a first step I suggest you to issue a legal notice to the builder against his deficiency of service and thereafter you can file a consumer complaint before the jurisdictional Consumer Disputes Redressal Forum claiming compensation against the builder as per your agreement.

Dear sir/madam, you have very good case on merit, you have to issued a legal notice to the said builder and thereafter you have to file the petition before the district consumer forum for the deficency of service of the builder in respect of giving rendering service to you, and also give the relief of delay possession of the compensation to you.

Dear Querist,
You can file consumer court case for deficiency of services, mental agony and compensation. You can also try to file a police compliant (en masse i.e join 10 or more aggrieved people) for cheating against the builder. If u go alone police may not take the case.
This apart you can also file a civil case for mandatory injunction directing the builder to hand over the posession of the property.

There are provision and enactment which will help you also since there is agreement with that cause it would be effective in getting justice ,hence nothing to worry you can apparoach a good lawyer and with time you can get property at time with compensation dealing directly without court might not serve you correctly .
