Lack in internet service can I take legal action against them?

If the ISP doesn't provide 24x7 service am I legally eligible for a waiver?

You have to first exhaust the remedies by writing to the service provider confirming that the services were not provided after that you may plan to initiate legal action for recovery of the amount already paid. Waiving the charges will depend on the service provider.
