Improper construction by builder what can be done

I had purchased an apartment from a top grade builder and the possession was due in December (including a grace period). Till November, the builder did not allow a visit to the site. Recently, when we visited the apartment, we found that construction is not as per specifications in the construction agreement. E.g. non-sliding balcony doors instead of sliding etc). On raising the issue with the builder, their team has refused to make the required changes. There is also a difference in the quality of the model apartment vs actual unit (disregarding furnishing). The builder is also delaying the possession and asking for balance amount due during possession if we want to complete the interiors even though we cannot live there (no electricity, OC, statutory approvals). What should be my next step to make sure the promised specification is delivered?

Dear sir,

I am sorry to hear that the builder is not providing the promised services and also the apartment/flat being built out of the specifications as promised. I would advise that you should initiate legal action immediately against the defaulting builder by pressing charges for deficiency in service either in consumer court or for criminal breach of trust before the criminal courts for more stringent action and for a favorable outcome. However proper advice can only be given upon looking into the documents/agreements and personal discussions.

This is a common problem which many flat buyers are facing with the builders these days. We have handled several consumer cases against many of these top grade builders to fetch profitable compensation to the clients. It will be good if you can consult a lawyer and strategize before taking any legal action against the builder. First u have to send legal notice to him asking him to provide the flat along with using condition and as per the terms agreed. Later u can moove to consumer court for their deficiency in service on their part
