How to get occupancy certificate from the builder

17-Apr-2023 (In Consumer Court Law)

I am deciding on a flat,.the apartment is ready to move in and has already more than 70% occupancy since last one year. Builder says he will give OC but will take 2/months. How to trust the builder? Is there a legal way to enforce and ascertain that OC will be obtained as promised from builder?

Dear Querist,
If there is a clause in your Sale agreement that builder will give OC even though the builder does not give the OC you can enforce your rights in the court of law before the consumer court or civil courts. If it does not form part of the agreement or MOU you'll have to trust him.
