How to get delayed possession of apartment

Hi, I have purchased an under-construction apartment in 2015 and as per the agreement for sale, the possession due date was 31-12-2016. The promoters and developers have so far not given the possession or any updates on the development and delay in possession. They are also not responding to emails and written intimation. Kindly advice.

Verify the actual status of development for it will be required to frame relief to be sought in consumer forum. If apartment is ready for possession, you can ask for possession and compensation for delay in delivering possession. If not, you can seek relief of direction against developer to complete construction and place you in possession with relief of compensation.

In this case checking copy of agreement will be essential to advise but as per above description giving notice as a consumer will be helpful. Its not clear from above query about how much amount has been paid, mode of payment and status of agreement is also unclear.

You need to file a complaint petition before the District Consumer Forum having jurisdiction of your area. Annex the copy of the Agreement along with the emails and another relevant documents related to your case.
